PRINCE ALBERT, Canada- A businessman has been sentenced to a year in jail for staging a sexual fantasy in which he hired someone to rob his store and tie him up naked with an unsuspecting woman.
"To say that this is bizarre and unique is an understatement," said Justice Gerald Allbright in sentencing Rosaire Roy of Prince Albert, Sask.
Early last fall, Roy, 55, discussed a sexual fantasy of his with Tracy Bannab, who gave police statements that were referred to extensively in court Tuesday.
Bannab said Roy told her he would pay her to stage a robbery at his business. She was to come in masked and toting a pellet gun, then order Roy and a 38-year-old female acquaintance of his to undress and get into a sexual position.
She was then to tie them together in that position and leave, taking with her the money from the till as compensation.
At about 6 p.m. on Oct. 19, 2001, Bannab arrived at the store as planned, masked and carrying the weapon. She ordered Roy and the woman to undress completely and get into the position before tying them together.
She told police she attempted to calm the victim, who was clearly frightened. She retrieved the money from the till and left.
The victim managed to free herself and Roy before calling the police.
At that point, she had no idea Roy himself had planned the robbery. Roy did not want the victim to know of his role for fear of harming their relationship, Crown prosecutor John Syrnick said in court.
"It was a cruel, insensitive thing to do to (the victim) and could leave her with no other feeling other than humiliation," said Allbright.
Roy gave police a false statement. But police soon discovered the truth and charged him.
Roy ended up pleading guilty to sexual assault and falsely reporting a crime.
Bannab was not charged, Syrnick said, because she did not realize the 38-year-old woman was not in on the act.
Roy tried to read a statement in court, but had to pass it over to his lawyer when he broke down in tears.
"I recognize my actions were foolish and childish," he wrote. "Words cannot compensate (the victim) for her losses.
"I wish I could turn back the clock," Roy said before breaking down.
"If he could turn back the clock, I have no doubt he would," responded Allbright.
"The clock, unfortunately, doesn't turn back."
Following the jail term, Roy will be on probation for 12 months. During that time, he cannot contact the victim.
